TERMS OF SERVICE – SPACE-STYLE AI IMAGE GENERATION

These Terms of Service (“Terms”) govern your use of the space-themed AI image generation service (the “Service”) provided by Atera Networks Ltd. or its affiliates (“we,” “our,” “us”). By uploading a photo and using the Service, you agree to these Terms.
1. Scope of Service
The Service allows you to upload a photograph of yourself, which we process through third-party AI technology to generate an AI-altered image in our company’s space style. This Service is provided as a complimentary, optional feature for our customers and prospective customers. It is not part of our core SaaS offering. The Service is provided without charge and strictly for your personal and internal use only.
Important: Our Service depends on third-party AI platforms that have their own terms and limitations. Platform availability and performance may impact service delivery.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding agreements. By using the Service, you confirm that you have the rights to the images you upload and have obtained necessary consents from any individuals depicted.
3. Acceptable Use
You agree not to use the Service, directly or indirectly, to:
i. Upload or generate content that is unlawful, harmful, defamatory, harassing, threatening, hateful, discriminatory, obscene, sexually explicit, exploitative of children, or otherwise objectionable.
ii. Infringe the intellectual property, privacy, publicity, or other legal rights of any person or entity.
iii. Violate any applicable law or regulation.
iv. Misuse, interfere with, disrupt, or attempt to reverse engineer or circumvent the Service or its underlying AI technology.
v. Upload any viruses, malware, or harmful code.
vi. Use the Service for military, surveillance, biometric processing, or automated decision-making purposes that significantly affect individuals
vii. Use the Service for commercial redistribution, model training, or competitive analysis
viii. Violate any third-party platform terms or model-specific restrictions applicable to our AI providers.
We reserve the right to suspend or terminate your access if you violate this Acceptable Use section.
4. Rights in Uploaded Photos and Generated Images
You retain all rights to the photographs you upload. By uploading, you grant us and our technology partners a limited, non-exclusive, worldwide license to use, process, and temporarily store your photos solely to provide the Service. You retain all rights to the generated images. We do not claim ownership, but we may temporarily store them to deliver the Service.
5. Privacy and Data Protection
We process photographs and related data only as necessary to provide the Service. We comply with the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). This includes: (i) Collecting only the minimum data required (your photo and technical metadata); (ii) Processing data only for the purpose of delivering the Service; (iii) Providing rights of access, correction, deletion, and portability; (iv) Not selling or sharing your personal data with third parties for advertising.
Data Retention: We endeavor to delete data promptly after service delivery, but actual retention periods may vary based on third-party platform requirements and our operational needs. Data may be retained longer where required for legal, regulatory, tax, accounting, or business record-keeping purposes.
Marketing Communications: We may use your contact information to send you marketing communications about our services, which you can opt-out of at any time.
Data Sharing: We may share your information with selected third parties to help us provide, improve, enhance, protect, and promote our Services, including hosting/storage providers, analytics providers, and our business partners.

6. Third-Party AI Platform Dependencies
Our Service relies on third-party AI. These platforms:
i. Have their own terms of service and acceptable use policies that apply to your use; ii. May impose specific restrictions on certain types of content or usage; iii. May experience outages, performance issues, or changes in availability, and iv. Process your data according to their own privacy policies and data handling practices
7. Disclaimers
The Service is provided “as-is”, without warranties of any kind, express or implied. We make no guarantees about the accuracy, quality, or suitability of AI-generated images. AI outputs may be unpredictable, and you use them at your own discretion.
8. AI-Generated Content Disclaimers
AI-generated images may:
i. Contain unexpected artifacts, distortions, or inaccuracies; ii. Inadvertently resemble copyrighted works or real individuals; iii. Include elements not present in your original photo; iv. Vary significantly in quality and style consistency.
You acknowledge that:
i. AI outputs are inherently unpredictable and experimenta; lii. You are responsible for ensuring appropriate use and disclosure of AI-generated content; iii. We recommend clearly identifying AI-generated images when sharing or publishing.
9. Limitation of Liability
To the maximum extent permitted by law, we disclaim liability for indirect, incidental, special, or consequential damages arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the greater of: (i) one hundred US dollars (USD $100), or (ii) the actual costs we incur from third-party platforms in connection with your specific claim.
10. Indemnification
You agree to indemnify us from claims arising from:
i. Your uploaded photos; ;ii. Your use of the Service; iii. Your violation of these Terms; iv. Any claim that your content infringes the rights of a third party.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Israel. Any disputes will be resolved exclusively in the courts of Tel Aviv-Yafo, Israel. No arbitration applies.
12. Modifications
We may update these Terms from time to time. Continued use after updates constitutes acceptance.
